Terms and Conditions
Application
1. These terms and conditions apply to all services offered by Melissa Brown Photography
2. When purchasing the service, the other party automatically (tacitly) agreed to the general terms and conditions.
Copyright
1. The copyright to the photographic work remain with the photographer.
Payment & Invoices
1. Payment must be made within 14 days of the invoice date, unless otherwise agreed.
2. If the photographer has not received the amount due after 14 days, the statutory 2% interest per month will be charged to the other party.
3. No use of the photographic work in any way whatsoever is permitted, as long as the other party had not yet paid outstanding invoice from the photographer.
4. The rates mentioned do not automatically apply to future assignments.
License
1. Permission for the use of a photographic work by other party is exclusively granted in writing/e-mail and in advance in the form of a license as described in the nature and scope of the photographer in the quotation and/or the order confirmation and/or the relevant invoice.
2. If nothing has been determined about scope of the license, it will never comprise more than the right to one-time use, in unaltered form, for a purpose, edition and manner as the parties agreed upon when entering into the agreement in accordance with the concept of the photographer, have meant.
3. The other party is not permitted to transfer the exploitation right described in the article to third parties without the prior written consent of the photographer.
4. Unless otherwise agreed, the other party is not authorized to grant sub-licenses to third parties.
Third party liability and Rights
1. It is under no circumstances possible to file (damage) claims with the photographer.
2. While taking the photos, you are responsible for your property and the photographer cannot be held liable for damage.
Algemene Voorwaarden.
Toepassing
1. Deze voorwaarden is van toepassing op alle diensten die worden aangeboden door Melissa Brown Photography.
2. Bij afname van de dienst gaat de wederpartij automatisch (stilzwijgend) akkoord met de algemene voorwaarden.
Auteursrecht
1. De auteursrechten op de fotografische werken blijven van de fotograaf.
Betaling & Facturen
1. De betaling dient binnen 14 dagen na het factuurdatum worden betaalt, tenzij anders is overeengekomen.
2. Indien de fotograaf het verschuldigd bedrag niet na 14 dagen heeft ontvangen wordt er de wettelijke 2 % rente per maand extra in rekening gebracht bij de wederpartij.
3. Geen enkel gebruik van het fotografisch werk op welke wijze dan ook is toegestaan, zolang de wederpartij enige uitstaande factuur nog niet heeft voldaan.
4. Genoemden tarieven gelden niet automatisch voor toekomstige opdrachten.
Licenties
1. Toestemming voor gebruik van een fotografisch werk door wederpartij wordt uitsluitend schriftelijk/per mail en voorafgaand verleend in de vorm van een licentie zoals die naar aard en omvang door de fotograaf is omschreven in de offerte en/of de opdrachtbevestiging en/of de daarop toeziende factuur.
2. Indien omtrent de omvang van de licentie niets is bepaald, geldt dat deze nimmer meer omvat dan het recht tot eenmalig gebruik, in ongewijzigde vorm, ten behoeve van een doel, oplage en wijze zoals partijen bij het aangaan van de overeenkomst conform het begrip van de fotograaf, hebben bedoeld.
3. Het is de wederpartij niet toegestaan het in dit artikel omschreven exploitatierecht over te dragen aan derden behoudens voorafgaande schriftelijke toestemming van de fotograaf.
4. Tenzij anders overeengekomen, is de wederpartij niet bevoegd om sublicenties te verlenen aan derden.
Aansprakelijkheid en recht van derden.
1. Het is in geen geval mogelijk om (schade) claims neer te leggen bij de fotograaf.
2. Tijdens het maken van de foto's ben je zelf verantwoordelijk voor uw eigendommen en kan de fotograaf niet aansprakelijk gesteld worden voor schaden.
